Welcome to the Listen Health Waitlist Referral Program (the "Program"). By participating in the Program, you ("Referrer" or "You") agree to these Terms & Conditions ("Terms"). This Program allows existing individuals on the Listen Health waitlist or existing clients (as defined by Listen Health) to refer new individuals ("Referred Friends") to join the Listen Health waitlist.
1. Eligibility for Participation
- Referrers: To be eligible to make referrals, you must be an individual who has legitimately signed up for the Listen Health waitlist or be an existing client of Listen Health, and be in good standing as determined by Listen Health in its sole discretion. You must be 18 years of age or older.
- Referred Friends: A Referred Friend must be a new individual who has not previously signed up for the Listen Health waitlist or used Listen Health services. They must use your unique referral code/link when signing up for the waitlist. Self-referrals are not permitted. Listen Health reserves the right to determine if a Referred Friend is a new individual.
2. How the Referral Program Works
- Unique Referral Code/Link: Upon joining the Listen Health waitlist [or becoming a client, specify as appropriate], you will be provided with a unique referral code and corresponding referral links (a "Referral Link" for our website, and a "Direct Referral Link" for our "Refer a Friend" Typeform).
Making a Referral:
- You can share your Referral Link with potential Referred Friends. When they click this link and subsequently sign up for the Listen Health waitlist through our primary Typeform, your referral code will be automatically captured.
- Alternatively, you may use the "Refer a Friend" Direct Referral Link found in your communications from us, which will take you to a form where you can enter the email addresses of friends you wish to refer. These friends will then be processed as described in these terms.
Sharing Referral Links: You agree to share your referral links responsibly and only with individuals you personally know and who you believe would be genuinely interested in Listen Health's services. You must not engage in spamming, bulk emailing, or any misleading or unethical practices to obtain referrals. You must comply with all applicable laws, including spam and privacy laws.
Attribution of Referrals: A referral is attributed to you when a Referred Friend successfully signs up for the Listen Health waitlist using your unique referral code/link, or when an email you submitted through the "Refer a Friend" form results in a new, unique individual joining our waitlist process.
3. Referral Rewards & Program Benefits
- Purpose: The primary purpose of this Program is to allow interested individuals to share information about Listen Health with friends who may benefit from our services.
- Waitlist Priority Ranking: Successful referrals may contribute to an improved priority ranking on the Listen Health waitlist for the Referrer. The ranking system is based on the total number of verified successful referrals attributed to you.
Priority Groups: Referrers will be placed into Priority Groups based on their total number of successful referrals:
- Priority 1: [e.g., 10 or more] successful referrals.
- Priority 2: [e.g., 5-9] successful referrals.
- Priority 3: [e.g., 1-4] successful referrals.
- General Waitlist: 0 successful referrals.
- Overall Rank: Within each Priority Group, individuals will be further ranked based on the total number of successful referrals (more is better), and then by their original signup date/time for the Listen Health waitlist (earlier is better) as a tie-breaker. An "Overall Rank" number will be assigned based on this system.
- Benefit of Priority Ranking: A higher priority ranking and/or placement in a higher Priority Group is intended to give individuals earlier consideration or access to Listen Health services when they become available, subject to service capacity, clinical appropriateness, and all other standard Listen Health onboarding procedures. Priority ranking does not guarantee service, a specific appointment time, or a specific outcome. All individuals, regardless of rank, must meet Listen Health's standard eligibility criteria for its services.
- No Monetary Rewards or Other Inducements: Beyond the potential for an improved priority ranking on the waitlist as described above, no monetary payments, discounts on regulated health services, gift vouchers, or other inducements are offered for participating in this Program or for making referrals.
- Changes to Benefits: Listen Health reserves the right to modify or change the structure of waitlist priority, Priority Groups, or any associated benefits at any time in its sole discretion.
4. Conditions for a Valid Referral
For a referral to be considered valid and contribute to your referral count and waitlist ranking:
- The Referred Friend must sign up using your unique referral code/link or be successfully processed as a new user through your submission to the "Refer a Friend" form.
- The Referred Friend must be a new individual to Listen Health (not already on our waitlist or an existing/past client).
- The Referred Friend must complete the Listen Health waitlist signup process legitimately.
- The referral must not be a self-referral, fraudulent, or generated by a script, bot, or other automated means.Listen Health reserves the right, in its sole discretion, to determine the validity of any referral.
5. Compliance with AHPRA Guidelines and Ethical Conduct
- No Misleading Claims or Testimonials: As a Referrer, you agree not to make any false, misleading, or deceptive claims about Listen Health or its services. You must not provide what could be construed as a testimonial regarding your personal health outcomes or the efficacy of Listen Health services. The Program is for sharing information only.
- No Encouragement of Unnecessary Use: You must not encourage the indiscriminate or unnecessary use of health services. Referrals should only be made to individuals who might genuinely be interested in and potentially benefit from Listen Health's services based on their own health needs and choices.
- Informed Decision: Referred Friends must make their own informed decision about joining the waitlist and potentially using Listen Health services. Your referral does not replace the need for a Referred Friend to consider their personal health situation and, if necessary, consult with their existing healthcare providers.
- Transparency: If you share your referral link, you should disclose that you may receive a benefit (i.e., improved waitlist ranking) if they sign up through your link.
6. Program Modifications and Termination
- Listen Health reserves the right to modify, suspend, or terminate the Program (or any part of it, including the reward structure or ranking system) at any time, with or without notice, in its sole discretion.
- Any changes to the Program will be effective immediately upon posting of the updated Terms & Conditions on the Listen Health website or other notification.
- Listen Health is not responsible for any loss or damage as a result of any modification, suspension, or termination of the Program.
- If the Program is terminated, Listen Health will, where reasonably possible, honor any priority ranking achieved up to the date of termination, but is under no obligation to do so.
7. General Conditions & Limitations
- Privacy: Personal information collected in connection with the Program will be handled in accordance with Listen Health's Privacy Policy [Link to your Privacy Policy Here]. By participating, you consent to the use of your information for Program administration. You also agree that when you refer a friend, they will know you have referred them.
- No Spam: You must comply with all applicable anti-spam legislation (e.g., the Spam Act 2003 in Australia). Any distribution of your referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will result in your immediate disqualification from the Program.
- No Transfer: Referral benefits (such as waitlist priority) are non-transferable, non-assignable, and cannot be redeemed or exchanged for cash or any other goods or services.
- Abuse of the Program: Listen Health reserves the right to disqualify any participant or cancel any referral benefits if it determines, in its sole discretion, that the participant has violated any of these Terms, engaged in fraudulent activity, or otherwise abused the Program.
- Liability: Listen Health will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Program, except for any liability which cannot be excluded by law.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of Western Australia, Australia.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
8. Important Notice Regarding Health Information
- This Program is not intended to provide medical advice. Information shared about Listen Health should not be interpreted as a substitute for professional medical advice, diagnosis, or treatment.
- Referred Friends should consult with an appropriate healthcare professional for any health concerns and before making any decisions related to their health or treatment.
- Listen Health services are subject to clinical assessment and may not be suitable for everyone.
